These Terms of Service ("Terms") govern your access to and use of the Gems Mart Jewellers website and any associated curated link, order, or inquiry surface (collectively, the "Service"). By visiting the Service, browsing our catalogue, or placing an order, you agree to these Terms.
If you do not agree to any part of these Terms, please do not use the Service.
Who we are
Gems Mart Jewellers is a family jeweller, established 1999, operating from 5 Mehar Chand Market, Lodhi Road, New Delhi, India. In these Terms, "we," "us," and "our" refer to Gems Mart Jewellers; "you" refers to the person using the Service.

Use of the Service
You may use the Service to browse our catalogue, submit inquiries, build a wishlist, and place orders through curated links shared with you.
You agree not to:
- Use the Service in any way that violates applicable laws or regulations.
- Attempt to access, scrape, or interfere with parts of the Service that are not intended for public use, including our administrative interfaces.
- Reverse-engineer or copy any part of the Service for commercial use without our written permission.
- Misrepresent your identity or submit fraudulent inquiries or orders.
Accounts
At present, the Service does not require you to create an account to browse or inquire. Your wishlist is stored anonymously via a browser cookie (see our Privacy Policy). Curated links are accessed via a unique shortcode; treat the link as you would any private communication.
Catalogue, pricing, and order acceptance
We work hard to keep product information, photographs, and pricing accurate. Even so, errors occasionally occur. We reserve the right to:
- Correct any errors or inaccuracies in product information, including pricing, descriptions, availability, or specifications, at any time and without prior notice.
- Decline or cancel an order if we believe it was placed in error, if the piece is no longer available, or if pricing was incorrect at the time of order.
A submitted order or inquiry is an offer, not a contract. A binding agreement forms only when we explicitly confirm acceptance — typically via WhatsApp or email.
Payments
For curated links with a payment option, payments are processed by Stripe, a third-party payment processor. By placing such an order, you also agree to Stripe's terms and privacy practices. We do not store your card details on our servers.
For all other orders, payment terms are agreed between you and us directly, and may include UPI, bank transfer, or in-person methods.
Jewellery — custom and ready pieces
We sell two broad categories of pieces:
- Ready pieces — finished, in-stock items photographed and described in our catalogue or in a curated link.
- Made-to-order or customised pieces — pieces produced or modified to your specifications. By their nature, these are not stocked and are not directly replaceable.
Refunds, returns, and exchanges are handled at our discretion, in keeping with our relationship-based approach. Please see our Refund Policy and Returns Policy for the substance of those decisions.
Intellectual property
All content on the Service — including photographs, written copy, the Gems Mart Jewellers brand mark, and our designs — is the property of Gems Mart Jewellers or used with permission. You may not reproduce, distribute, or use any of it for commercial purposes without our written consent.
Personal, non-commercial use (such as saving a photograph for your own reference while considering a purchase) is fine.
Disclaimer of warranties
The Service is provided "as is" and "as available." While we take reasonable care to keep it accurate and operational, we make no warranties — express or implied — about its uninterrupted availability, fitness for a particular purpose, or freedom from errors.
Photographs are representative; small variations in colour, finish, and stone positioning are normal in handcrafted jewellery and do not constitute a defect.
Limitation of liability
To the maximum extent permitted by applicable law, Gems Mart Jewellers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim arising from a specific order shall not exceed the amount you paid for that order.
Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts at New Delhi.
We genuinely prefer to resolve any concern in conversation before it becomes a dispute. Please reach out to us directly.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the current version. Continuing to use the Service after a change constitutes acceptance of the updated Terms.
